These Website Terms of Use (“Terms”) govern our Site. By using our Site, you are agreeing to these Terms. Please read these Terms carefully. By using our Site and our Services, you warrant that you have had sufficient opportunity to access these Terms and contact us, and that you have read, accepted and will comply with and be bound by our Terms, and that you are 18 years or older. If you do not agree to these Terms, then you are not allowed to use this Site and should immediately terminate such usage.

You warrant that you will comply with all applicable laws in accessing and using this Site.

The terms “us”, “our” or “we” refers to Altum. You acknowledge that we may use your personal information and data according to our Privacy Policy, available on our Site at www.altumsupport.com.au/legal/privacy. These Terms and our Privacy Policy, together with our Service Terms and Conditions, supplied to you in the event that you subscribe to use our Services, govern the relationship between Altum and you in connection with the use of our Services. You hereby agree to the terms of our Privacy Policy including any obligations imposed on you therein.

2. USE OF CONTENT

Unless otherwise indicated, the content on this Site is provided by us.

Unless otherwise indicated in the relevant content, and on the condition that you comply with all of your obligations under these Terms, you are authorised to view, copy, print, and distribute (but not modify) the content on this Site; provided that (i) such use is for informational, non-commercial purposes only, and (ii) any copy of the content that you make must include the copyright notice or other attribution, if any, associated with the content.

This Site contains general information only, and we are not, by means of this Site or any part thereof, rendering professional advice or services. Before making any decision or taking any action that might affect your finances or business, you should consult a qualified professional advisor. In the event that you subscribe to become a user of Altum, you will be provided with additional terms and conditions to govern that arrangement.

This Site is provided as is, and we make no express or implied representations or warranties regarding it. Without limiting the foregoing, we do not warrant that this Site will be error-free or will meet any particular criteria of performance or quality. We expressly disclaim all implied warranties, including, without limitation, warranties of merchantability, title, fitness for a particular purpose, non-infringement, compatibility, security, and accuracy.

Your use of this Site is at your own risk and you assume full responsibility and risk of loss resulting from your usage. 4. SUBSCRIPTION

Should you choose to purchase a subscription to receive Altum’s Back Office support on a monthly basis, you will be deemed to have entered into a subscription contract with us. A contract is created once you agree to the Service Terms and Conditions and pay the relevant fee to us. Your subscription will automatically renew unless you cancel the subscription before the relevant renewal date. You authorise us to collect any applicable subscription fee, using any valid payment method we have on record for you.

Unless otherwise agreed, you will be charged the relevant subscription fee on a monthly basis. Unless otherwise agreed, the fee will be charged on the last business day of the month. You will continue to be charged the relevant monthly fee until you cancel your subscription.

You authorise us to charge the credit or debit card supplied on a monthly basis. If we are unable to charge a credit or debit card that you have provided, you agree to provide the details of another credit card, or pay the amount owed in some other manner as agreed between yourself and us. In addition to the amounts owed you also agree to pay for any associated dishonour fees, as set out in the Service Terms and Conditions.

You acknowledge and agree that if we are unable to charge a credit or debit card that you have provided, we will cease to provide Services to you and you will not be able to access our Services or login to your Altum Portal until payment is made.

All prices displayed on our Site are in Australian Dollars and are exclusive of GST unless otherwise stated. Our prices and payment methods may be amended from time to time at our discretion.

5. REFUND POLICY

Unless otherwise provided by law or by a particular Service offer, all purchases are final and non-refundable. If you believe that Altum has charged you in error, you must contact us within 90 days of such charge. No refunds will be given for any charges more than 90 days old. We reserve the right to issue refunds or credits at our sole discretion. If we issue a refund or credit, we are under no obligation to issue the same or similar refund in the future. This refund policy does not affect any statutory rights that may apply.

6. CANCELLING THE SERVICES

You may cancel our Services at any time, with or without cause. Information and directions on how to cancel the Services and request a refund, if you are entitled to one, is provided on the ‘Altum Account Management’ page of this Site. You should refer back to the Service Terms and Conditions as (i) you may not receive a refund at the time of cancellation; (ii) you may be obligated to pay cancellation charges; (iii) you may be obligated to pay all charges made to your billing account for the Services before the date of cancellation; or (iv) you may lose access to and use of your account when you cancel the Services. If you cancel, your access to the Altum Portal and Altum Services ends at the end of the period in which you cancelled, unless otherwise required as set out in the Service Terms and Conditions.

7. PRICE CHANGES

We may change the price of the Services at any time and we will notify you by email at least 60 days (2 subscription periods) before the price change takes effect. If you do not agree to the price change, you must cancel and stop using the Services before the price change takes effect. If you have a fixed term agreement as part of your agreed Service Terms and Conditions, that price will remain in force for the entire Term.

8. RESTRICTED USE

You agree not to use the Services for unauthorised or unlawful purposes (unauthorised use of any of our Services may be a criminal offence and/or give rise to a claim for damages); or re-sell or attempt to benefit in a commercial fashion from any documents you have gained from the Services, other than the purpose for which you obtained the Services.

Should we deem that you are potentially using our Services for commercial gain or in a manner which could damage our business and repute, we reserve the right to cancel your subscription, and we are under no obligation to make any refunds to you.

9. COMPETITORS

Competitors, including companies offering business support or similar services, are not permitted to access or use any Information or Documents accessible on our Site and are not permitted to use our Site.
